Data Processing Agreement (DPA)

This Data Processing Agreement ("DPA") forms part of the Terms of Use between you ("User", "Customer", or "Data Subject") and INTERNATIONAL BUSINESS AND LEADERSHIP INSTITUTE LLC ("IBLI Global", "we", "us", or "our"). This DPA applies to the processing of personal data in connection with your use of the IBLI Global platform.

1. Roles of the Parties
IBLI Global acts as a Data Controller with respect to personal data collected through the Platform.
In certain cases, IBLI Global may act as a Data Processor when processing data on behalf of users (for example, account data or user-generated information).
2. Categories of Data Processed
IBLI Global may process the following categories of personal data:
- identity data (name, username)
- contact data (email address)
- account data (login credentials)
- course activity and completion records
- technical data (IP address, device information)
- usage data (platform interaction)
3. Purpose of Processing
Personal data is processed for the following purposes:
- providing access to courses and services
- managing user accounts
- processing payments
- issuing certificates
- improving platform functionality
- ensuring security and fraud prevention
4. Legal Basis for Processing
We process personal data under the following legal bases:
- performance of a contract
- legitimate interests
- compliance with legal obligations
- user consent (where applicable)
5. Sub-Processors
IBLI Global may engage third-party service providers ("Sub-Processors") to process personal data, including:
- Stripe (payments, via Jazmin Business Group, LLC)
- hosting and infrastructure providers
- email delivery services
- analytics providers
All sub-processors are required to implement appropriate data protection safeguards.
6. International Data Transfers
IBLI Global operates in the United States. By using the Platform, you acknowledge and consent to the transfer of personal data to the United States and other jurisdictions where our service providers operate.
Where required, we implement appropriate safeguards for international data transfers.
7. Data Security
IBLI Global implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or disclosure.
However, no system can guarantee absolute security.
8. Data Retention
Personal data is retained only as long as necessary to:
- fulfill contractual obligations
- comply with legal requirements
- resolve disputes
Course completion and certification data may be retained for verification purposes.
9. Data Subject Rights
Users may exercise the following rights (subject to applicable law):
- access personal data
- correct inaccurate data
- request deletion
- restrict processing
- request data portability
- object to processing

10. Breach Notification
In the event of a data breach affecting personal data, IBLI Global will take appropriate steps to investigate and, where required by law, notify affected users and relevant authorities.
11. Governing Law
This DPA shall be governed by the laws of the Commonwealth of Kentucky, United States.
